Information on personal data processing of job applicants and request for consent to processing

Who is the controller of personal data?

The controller of personal data is company Hyundai Motor Manufacturing Czech, s.r.o., with its registered office at Průmyslová zóna Nošovice, Hyundai 700/1, 739 51 Nižní Lhoty, company reg. no. 27773035, registered in the Commercial Register maintained by the Regional Court in Ostrava, C 41484 (hereinafter referred to as HMMC).

What are the purposes of personal data processing?

Personal data about candidates, specified below, will be processed by HMMC for the following purposes:

  • Choosing appropriate employees within an ongoing selection procedure (conclusion of employment relationship) For the selection of appropriate employee and subsequent conclusion of employment agreement (or agreement on the performance of work or agreement on work activity), it’s necessary to process personal data of candidates involved into the selection procedure. This purpose is fulfilled by the completion of selection procedure.
  • Potential repetitive contact with job offer in the future (after the termination of selection procedure) Data about applicants may be processed with the consent of applicant (see point 7 below) and for any further potential job offer in the future. Data will be kept by the end of the 3. calendar year after the termination of original selection procedure.
  • Protection of eligible interests of HMMC (protection of HMMC) As a consequence of selection procedure, personal data of unsuccessful applicants will be kept also after its end for the purpose of protection of eligible interests of HMMC. This processing is related, in particular, to the protection against any potential dispute with applicant in relation to his/her non-acceptance or against the inspection held by inspection authorities. Personal data will be kept for the period of 3 years after the end on selection procedure (statute-barred period).

What personal data are processed?

Scope of personal data corresponds to the purpose of its processing strictly. Thus, HMMC will process in particular personal data kept in personal questionnaire or CV of applicant or in following submitted documents (documents on education, motivation letters etc.), and also the data handed over in person during the interviews etc. 
Personal data is also collected within the activities of HMMC (e.g. evaluation of HR officer or manager). Data may be acquired from other sources as well, e.g. within professional social networks or HR agencies.

Legal basis of personal data processing and request for consent

The provision of data for the purpose of choosing appropriate employees as referred to in a) above is not mandatory, however, for the right evaluation of applicant to be hired it is necessary. The processing of the data for the purpose under c) above is based on HMMC's legitimate interests as described above.  
The provision of data for the purpose under b) above, i.e. to be approached again with a job offer in the future, is voluntary and requires the consent of the job applicant. The job applicant gives this consent by ticking the relevant box included in the registration form. The candidate has the right to withdraw his/her consent at any time (e.g. by e-mail to [email protected]). Withdrawal of consent does not affect the lawfulness of previous processing based on consent.

Is there a fully automated decision-making process?

HMMC processes personal data both manually and by automated means through computer technology. While processing personal data, neither fully automated decision-making, nor profiling is used.

Are your personal data safe?

Protection of personal data in HMMC is ensured organizationally and technically in accordance with relevant legislation. Also all processors, which process personal data for HMMC, provide comparable standard of personal data protection.
Personal data is under constant physical and electronic control. HMMC has modern control, technical and security mechanisms to ensure maximum protection of processed data from unauthorized access or transmission, loss or destruction, and other possible misuse.
Every person, who come into contact with personal data, in the performance of their work or contract obligations is bound by a statutory or contractual obligation of confidentiality.
Personal data may be shared also with external partners and advisers of the Controller (e.g. suppliers, lawyers, auditors, IT solution providers, etc.) if there is a legitimate interest of the Controller or a third party. Personal data may be shared also with public authorities or other institutions, if required by law.

What are rights of data subject?

In accordance with applicable law, in particular with Articles 15 – 21 of the Regulation of the European Parliament and of the Council (EU) 2016/679, the General Data Protection Regulation (the “GDPR”) the job applicant can exercise your rights of data subject:

  • the right to access the data we process, the right to the portability of personal data and the right to request the correction of inaccurate or incomplete data;
  • the right to object processing of personal data according to Article 21 of GDPR;
  • the right to file a complaint with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz;
  • the right to erasure of his / her personal data or limitation of its processing.
